Thesis
A military organization cannot use its own failure to identify a war criminal as a defence against responsibility.
When a civilian is deliberately hunted by a drone, the commanding officer cannot simply say:
„Wir haben es nicht gewusst.“
«Мы понятия не имели».
We had no idea.
The inability to name the operator is not evidence that nobody is responsible. It is evidence that responsibility has been deliberately scattered, neglected or concealed.
A military unit possesses weapons, operators, communications systems, duty schedules, launch positions, ammunition records and chains of command. It knows who is assigned to a sector. It knows who receives equipment. It knows which team is operating at a particular hour. It knows who gives orders and who reports the results.
When all of this knowledge suddenly disappears after a civilian is attacked, ignorance is no longer an innocent condition.
It becomes an institutional product.
The problem
The traditional system of war-crime prosecution demands that investigators identify the individual perpetrator. That principle is necessary, but modern military organizations have learned how to weaponize it.
The operator hides behind the unit.
The unit hides behind the commander.
The commander hides behind the chaos of war.
And the state hides behind the claim that no individual can be identified beyond reasonable doubt.
The result is a perfect machine for producing impunity.
The officer says:
Wir haben nicht verstanden, was dort geschah.
«Мы не понимали, что происходило».
We did not understand what was happening.
But this is not a civilian describing confusion during an air raid. This is a commander responsible for the controlled distribution of lethal force.
War is chaotic for the victim.
For the institution launching the weapon, war is organized through frequencies, sectors, rosters, logistics, targeting systems and orders.
A drone does not materialize spontaneously above a vegetable seller. Someone acquired it. Someone transported it. Someone armed it. Someone launched it. Someone piloted it. Someone watched the transmission. Someone maintained the communications network. Someone commanded the unit responsible for that territory.
If none of these people can be identified, then the command structure has failed in one of two ways.
Either it failed to maintain control over lethal force, or it deliberately destroyed the trail leading to the perpetrator.
Both are culpable.
The commander therefore cannot be permitted to answer an accusation with:
I cannot tell you who did it. War is chaotic. Your demand is unreasonable.
The demand is not unreasonable.
The unreasonable act was deploying lethal machinery without preserving accountability for its use.
A military force that can count its drones but cannot identify its drone operators has not lost control accidentally. It has created deniability as an operational resource.
Thesis
The correct answer to institutional ignorance is not collective punishment. It is compulsory collective accountability.
Once a war crime has been credibly attributed to a military unit, that unit must be legally required to identify the operational chain involved. It must produce the duty rosters, communications records, mission logs, launch locations, video feeds and command instructions.
If the unit produces the perpetrator, the perpetrator is prosecuted.
If the unit conceals the perpetrator, those responsible for the concealment are prosecuted.
If the commander claims that no records exist, the commander must answer for deploying lethal force without an auditable command structure.
If the records were destroyed, their destruction becomes a separate crime.
The commander must not be allowed to escape through a third category called uncertainty.
There are only two possibilities:
The command knew who was operating the weapon.
Or the command permitted weapons to be operated without knowing.
In either case, command responsibility remains.
The old refrain was:
„Wir haben es nicht gewusst.“
«Мы понятия не имели».
We did not know.
The slightly more sophisticated refrain became:
„Wir haben nicht verstanden, was dort geschah.“
«Мы не понимали, что происходило».
We did not understand what was happening.
But beneath both statements lies the real institutional truth:
Es war uns scheißegal.
«Нам было наплевать».
We did not give a shit.
That is the thesis.
Ignorance created by command negligence is not innocence.
Ignorance preserved through institutional silence is complicity.
And ignorance deliberately constructed to protect a war criminal is itself part of the crime.
So, throw the book at the entire unit.
