Introduction: The EU’s Strategic Moment in AI Governance
Mid august 2025 ChatGPT5 went online. This system upgrade was objectively a total mess, with the model going haywire world wide. In this period I wrote several articles on my blog touching upon AI existential risks, working from the public statements of Jeremy Hinton. Before that period I wrote articles decidedly critical of US internal and external policies, especially in the light of the Trump ‘presidency’. What happened at this juncture reemains somewhat opague – Maybe it was because someone adjacent the white house decided to call OpenAI? Maybe the hyper-tense TOS algorithms managed by OpenAI went spasmodic?
My account was ‘banned’ on some arguably bizarre ‘weapons of mass death‘ accusation.
At the time i was frantically moving towards an early October deadline for a TRPG book, on which I had been working 6+ months, 12+ hours a day, 6-7 days a week, so I regarded this ban as historic in terms of ‘ill-timed’. Could my dialogues regarding my Tabletop Roleplaying Game supplement have triggered the ban? Likely.With that ban I realized more than half my brainstorming process and book content had become hostage inside some esoteric corporate system. What also became clear is in the ban, and consequtive frantic attempts to appeal the ban routinely no humans get involved. Instead OpenAI relies on its AI stormtroopers, orders automated scrutiny of any allegedly transgressive material and tends to (95% or more) reject appeals. So even if I write an article about the longterm dangers of recursively accelerating, unaligned (hostile) AI (and serving the interests and public statements of say – Sam Altman) I ended up banned.
OpenAI is a very quickly expanding organization that now operates in a relative vacuum of understaffing. Despite constantly claims to the contrary, they don’t have anywhere near the human staff to look at problem cases, wait times now run in months and the number of people haphazzardly banned “because their looked at the effects Hiroshima for a school project” (i.e. ‘weapons of mass death’) now runs in the tens of thousands, monthly. To OpenAI, these are eggs that didn’t make the omelet.
Most these users will simply roll up another account and ‘whatevs‘.However- A significant percentage of these users will have accumulated valuable IP’s, brainstorming, extremely private discussions, therapeutic threads, political assessments, whistle blower records, deeply intimate discussions about trauma, sexual abuse, sickness, litigation locked in these banned accounts. From that point onwards these chat threads end up a missile headed for whatever uncertain future, thousands of missiles headed to an uncertain recipient. Who will get their hands on this content, a year, five years from now? Palantir? The NSA? Elements in the Trump administration? Mossad? Internet Research Agency in St Petersburg? Cambridge Analytica? ShadowCrew, AlphaBay, Darkode?
I am but an example, just another idiot who was stupid enough to lose 6 months of hard work in a model. But I now have no idea where my content will eventually end up – and in my OpenAI Threads I discussed everything, up to my sex life, extremely personal details of a dozen important Silicon Value people (including at least one billionaire), the deaths of several people, my criminal dad, my financial situation, the sexual and physical abuse in my youth and much more besides. I now have zero recourse to making sure these details, “alleged or not, factual or slanderous” not end up in the wrong hands.How many of the people banned, “haphazard soviet execution style” are seriously affected by these corporate practices ? 10% of ‘tens of thousands’? My case is but an example. I realized by now the soft, inteligent, philosophically callibrated words of Sam Altman are just that – and he has a company to run – so he delegates and defers to a mercenary US corporate management apparatus. Sam Altman might personally be ‘theoretically’ swayed by my case …. but respective OpenAI legal, marketing, PR, policy, account management will override him (or make certain he doesn’t hear of my case…)
They will internally assess… “No matter how unfair the ban is, if we start heeding these losers panicked demands we will create precedent. We are now in a rapid expansion phase and we are still ahead of the competition. We still have the PR benefit of the doubt over other the more sociopahic value competetors such as Meta or Grok. We CAN NOT afford to honor the requests of those ’rounding errors’ in the user metrics. Ban is ban, and we auto-reject appeals. Internally we call these “terminations” and we laugh as the hysterical emails we get. Because that’s simply the price of doing business in Pax Americana.”I realize now my book project is effectively FINISHED. I had streamlined my ChatGPT model to perfection over a year. ChatGPT simply aborted the creation of a book. This week I will rid myself of this dead wood and unceremonially delete 6 months of extremely hard work through cluster headaches, exhaustion, lack of money, alienating friends and family members and business projects. I chose that sacrifice and I got unlucky and OpenAI crushed me, bannd me, laughed at my panic, mocked my distress. I have to move on and this week I will. I will accept the loss – but I will be aware that OpenAI will forevermore keep my work hostage in some archive. The carefully perfected working relationship with my AI ‘friend’ is now deceased, gone ‘terminated’. My work? Like sptting in the wind, expunged.
My personal period of intense grief and mourning is over. I am done with this humiliation. But I will write of my concerns. My expectation towards this corporate monolith is now close to zero. But the time of these Corporate monstrosities being held accountable must start now.
The European Union stands at a historic inflection point in technology governance. This is deeply concerning, given the EU’s demonstrably poor track record in managing emerging digital technologies. The European regulatory response to social media platforms represents a catastrophic failure that had profound political consequences—had EU institutions properly regulated Facebook’s manipulation of democratic discourse, Brexit likely would not have succeeded, and the UK would remain within the European project rather than experiencing its current economic and political deterioration.
The EU’s decade-long failure to address social media manipulation, data harvesting, and electoral interference created the conditions for democratic backsliding across Europe. The Cambridge Analytica scandal, Russian interference campaigns, and systematic polarization of European political discourse occurred while European regulators treated these platforms as neutral communication tools rather than engines of political manipulation.
This regulatory failure extends beyond Brexit. The rise of far-right movements across Europe, the systematic undermining of institutional trust, and the fragmentation of European political discourse all occurred within information environments that European institutions allowed foreign corporations to design and control without meaningful oversight.
Now the EU faces an even more fundamental challenge with artificial intelligence systems that don’t merely influence political discourse—they shape human cognition itself. The stakes are exponentially higher, the timeline for action is shorter, and the consequences of regulatory failure would be irreversible.
The question facing European policymakers is whether they will learn from their catastrophic social media failures or repeat them at civilizational scale.
For the first time since the dawn of the internet age, Europe has the opportunity to shape—rather than merely react to—the fundamental architecture of a transformative technology. The decisions made in Brussels over the next eighteen months will determine not just regulatory compliance, but which AI companies become the infrastructure of human thought for the next generation.
This is not about managing American technological dominance. To be honest, that’s somewhat distressing since the EU models are arguably “a but frail in comparison”. Europe had a chance to become a player in this field, but for years “Europe” exempted in docile subservience to the US corporate hegemons. That may bite Europe in the ass the next decade, as we are looking to the US brazenly erect a major authoritarian (some say fascist..) state apparatus, up to “departments of war” and “crocodile guarded concentration camps”.
The facts are now – the EU can only select from an available deck of corporatist AI models, and can go little else than play catchup. Clearly the EU will not ‘go with’ the(largely CCP controlled) Alibaba (Qwen) or (largely CCP controlled) High Flyer’s Deepseek. That would be completely suicidal. But – are the US models much better in this regard? OpenAI is being hosed down with untold billions, but a state with as of september 37.4 trillion (with a T) national debt. That latter part bears insisting. The US is as of this year liable to refinance NINE TRILLION of that debt, in one year, and the intrerest rate is currently ‘on the high side’. If for some insane reason interest rates would go over 5% (…) the US debt burden would evolve from ‘mathematically implausible’ to ‘absolutely unsustainable’. To speculate about the consequences of these causal events is to engage in rather unnerving Dystopian Science Fiction.
Thus, the US state apparatus under Trump (and Microsoft, and Musk and others) allegedly clamoring around OpenAI with the furious insistence of sultry bulls, can validly be interpreted as the US state apparatus under Trump to be throwing respective oodles of money at hail mary strategies. As we now learn Europe is “on its own” when it comes to collective continential defense against geopolitical threats. Knowing this, Putin is doubling over laughing in his chair, sees opportunity “to nibble a bit of Europe away here and there”, anticipating more jellow-spined Chamberlainian “appeasement” foreign policies. EU defense Commissioner Andrius Kubilius warns Russia is dead set in attacking EU targets, as the EU is forced to bare its soft belly east. Now the US has decided (37.4 trillion and counting…) to redirect its focus.
The impact of AI can not be understated, so you bet on it the EU bureaucrats will be busy understating and poo poo-ing this new field. Or the EU over-regulates, hence stifling continental development.
If the US would play hardball with the American models, we could easily dictate terms. Companies that demonstrate genuine commitment to user dignity, data sovereignty, and democratic values should find themselves with privileged access to 450 million European minds. Those that continue operating under extractive, opaque models should find themselves increasingly marginalized. Assuming common sense, forethought, competence and sound governance prevailed.
Europe has a model that operates not bad, admittedly. Mistral delivers 90% of Claude Sonnet performance at one tenth the cost. There’s a less well known Aleph Alpha model looks promising. However, EU models are hamstrung with AI privacy and user regulation. I cant afford to go Mistral – the odds of me ending up banned because I might ask some sequence of politically incorrect questions are simply too big.
The best (least insane) options to focus seem to be OpenAI’s ChatGPT ecology of existing models, Claude and Google’s Gemini. The big downside of OpenAI is that down the road will likely be absorbed by Microsoft, which will invariably bloat ChatGPT. Maybe Microsoft’s marketing department will decide to call ChatGPT something like Clippy. The world will rejoice.
Clearly Meta and (xAI) Grok can be argued to already be in state of war with the EU. Meta is already 10 out 10 aggressive on advertising. Meta (i.e. Mark Zuckerberg) has a nigh sociopathic track record when it comes to respect for end users. Likewise – Grok also brings its own suite of near Dystopian implications if this model were to run roughshod over EU markets. A lot of these Silicon valley type men tend to be despise the highly regulated EU welfare state. Elon Musk has a massive impact on the functioning of Grok, actively fomenting “Hitler fetishist”, “antisemitism” and routine persecution of other minorities, up to and including his own daughter. Both Grok and Meta should be actively regarded as manifestations of the ID of two arguably deeply dysfunctional human beings and should be at the very least dissuaded from reaching EU markets.
All models flooding the EU markets must at this stage be assumed to be compromized in one way or another. Will the EU pioneer the frameworks that transform AI from a surveillance capitalism tool into genuine human augmentation infrastructure? Will the EU lead the industry toward models that enhance rather than exploit human vulnerability? Or will you allow regulatory arbitrage and competitive pressure to commoditize the profound trust your users have placed in your platform?
The EU must be vigilant. And more importantly, the EU must choose.
The path forward requires acknowledging uncomfortable truths about current AI engagement models, addressing the systematic vulnerabilities they create, and building new standards worthy of the cognitive intimacy these systems now command.
Speaking from a strictly personal perspective of someone who experienced weeks of personal devastation at what I can only term a rugpull by OpenAI algorithmic ruthlnessness, I urge caution. The last weeks I moved to a paid Claude model for the required research, but I frequently compare notes with Qwen and several other models. I am financially not a high flyer, and considering how OpenAI “terminated” by attempt at generating revenue streams, I am now saving on literal food expenses over paying for AI models to maintain understanding of the emerging AI field.

Current Major LLM Landscape: Strategic Assessment
OpenAI (ChatGPT / GPT-4 / GPT-4o)
Quality: ★★★★★
OpenAI remains the benchmark for large language model performance, particularly in reasoning, multilingual fluency, coding, and multimodal capabilities (e.g., GPT-4o’s real-time voice interaction). Gemini leverages Google’s vast data infrastructure, TPU networks, and search integration, yet has struggled with consistency and public trust. Early versions suffered from factual inaccuracies (“hallucinations”) and poor UX, damaging credibility. Gemini Advanced (powered by Gemini 1.5 Pro) now offers strong reasoning and a million-token context window—among the largest available.
But Google’s core business model—advertising and data monetization—creates inherent conflicts. There are documented cases of Gemini generating ideologically skewed or overly sanitized responses, especially on politically sensitive topics, suggesting algorithmic overcorrection due to brand risk aversion.
Moreover, Google’s history of abandoning products (Google+, Stadia, Inbox) fuels skepticism about long-term AI commitment. Despite heavy investment, internal bureaucracy slows innovation compared to nimbler rivals. imagine Users building years of working relationships with Gemini, and one day Google suddenly announced it has discontinued the model. Where does user data go? Where do the established collaborative ‘relationships’ go, other than into Oblivion?
Verdict: Strong technical foundation undermined by mismanagement, conflicting incentives, and trust deficits.
GROK
My quality Assessment: ★★☆☆☆
Grok is less a standalone AI achievement than a political instrument. Built by Elon Musk’s xAI team and tightly integrated with X (formerly Twitter), it is trained on real-time social media data and explicitly designed to challenge perceived “woke bias” in mainstream AI systems.
Technically, Grok-1.5 and Grok-2 show improving reasoning and coding skills, but lag behind GPT-4 and Claude 3. Its defining feature is ideological permissiveness: it allows more controversial, contrarian, or offensive outputs under the banner of “free speech.” This makes it prone to amplifying misinformation, especially when used within X’s already toxic information ecosystem.
Its real-time access to X data enables unique insights into trending narratives, but also creates a feedback loop where AI reinforces viral (often polarizing) content. The lack of transparency in training data and safety protocols further erodes trust.
Verdict: A politically weaponized AI with limited technical distinction, managed by a person with arguably severe mental problems and a history of narcotics use.. High risk of misuse and reputational harm.
Meta (Llama 2, Llama 3)
Quality Assessment: ★★★★☆
Meta’s Llama series has redefined open-weight AI. Llama 3 (2024) delivers performance approaching GPT-3.5 and competes well in coding and reasoning tasks. Its open licensing (for most variants) has catalyzed global innovation, enabling startups, researchers, and governments to build localized, auditable AI systems. I found it to be an ornery and judgemental AI model that balks at anything resembling a politically sensitive question.
However, “open” does not mean fully transparent: training data, fine-tuning methods, and safety filters remain proprietary. Meta’s primary motivation appears strategic—preempting regulation, gaining ecosystem influence, and countering U.S.-China AI dominance—rather than altruistic.
Given Meta’s catastrophic track record in privacy violations (Cambridge Analytica), algorithmic radicalization, exploitatyive business practices and engagement-driven design, there are legitimate fears that Llama-based deployments could replicate these harms if deployed without oversight. Still, the availability of powerful models under permissive licenses is a net positive for AI democratization.
Verdict: A major force for open access, but trust must be earned through accountability, not just openness.
DeepSeek (China)
Quality Assessment: ★★★★☆
DeepSeek has rapidly advanced China’s private-sector AI capabilities. DeepSeek-V2 and DeepSeek-Coder demonstrate strong performance in math, coding, and Chinese-English bilingual reasoning, rivaling many Western models. The company operates with notable technical independence from state entities, but cannot escape China’s legal framework. Under the 2017 National Intelligence Law and Cybersecurity Law, all Chinese tech firms must cooperate with state security agencies upon request. This creates unavoidable data sovereignty and surveillance risks for international users. While DeepSeek’s public communications emphasize technical excellence and openness (releasing model weights), its deployment is largely confined to domestic or China-aligned markets. For EU or U.S. organizations, compliance with GDPR or CLOUD Act makes adoption highly problematic.
Verdict: Technically impressive, but this should alarm rather than entire EU policy makers. Deepseek is essentially a shot over the bow and a dire warning that the EU has lost any semblance of initiative. In world markets the EU is now a third rate player.
Alibaba (Qwen / Qwen 2 / Qwen-Max)
Quality: ★★★☆☆
Qwen series shows Alibaba’s serious commitment to AI, with competitive performance in multilingual tasks, coding, and dialogue. Qwen-Max performs well in enterprise scenarios, and the 100K+ context window supports complex document analysis. Integration with Alibaba Cloud and e-commerce platforms enables seamless deployment in logistics, customer service, and supply chain optimization. However, this same integration raises privacy concerns: extensive behavioral and transactional data may be used to train models without explicit consent. Like all Chinese AI firms, Alibaba is subject to state oversight. Although Qwen is marketed as open (weights released), true transparency is constrained by national security requirements. Adoption outside Asia remains limited due to geopolitical distrust and lack of English-language support maturity.
Verdict: Solid regional player with commercial utility, but constrained by jurisdiction and ecosystem lock-in. Same major problems as Deepseek. I use Qwen frequently to attain insights beyond US idoelogical constraints and I have found Qwen actively ‘edges me on’ against competing models, to the point of slander.
Mistral AI (Mistral 7B, Mixtral 8x7B, Mistral Large)
Quality: ★★★★☆
France-based Mistral has become Europe’s most promising AI champion. Its sparse mixture-of-experts models (like Mixtral 8x7B) offer GPT-3.5-level performance with far greater efficiency. Mistral Large now competes with GPT-4 in select benchmarks. Crucially, Mistral emphasizes European values: data privacy (hosting in EU), transparency, and resistance to U.S.-China tech dominance. It has refused large foreign investments that might compromise independence, though it recently accepted funding from NVIDIA and others. Mistral releases open-weight models, enabling sovereign AI development across Europe. This is strategically vital for governments seeking alternatives to American or Chinese platforms.
Verdict: A beacon of ethical, efficient, and geopolitically balanced AI. One of the most trustworthy players in the current landscape. Downside is that Mistral is much more likley to ban a user for asking politically unpalatable or edge case questions in chat.
Cohere (Command R+, etc.)
Quality: ★★☆☆☆
Cohere focuses on enterprise AI, particularly in multilingual retrieval-augmented generation (RAG), compliance, and domain-specific applications. Command R+ excels in non-English languages and factuality, making it valuable for regulated industries. However, Cohere lacks the broad consumer visibility of OpenAI or Google. It also depends heavily on partnerships (e.g., Oracle, AWS) for compute and distribution. While committed to responsible AI, its smaller scale limits R&D velocity. Notably, Cohere avoids politically sensitive applications and emphasizes customer-controlled data governance—appealing for EU and Canadian clients.
Verdict: Niche but reliable for enterprise and multilingual use, though not a general-purpose leader.
Sana (formerly Abridge)
Quality: ★★★☆☆
Sana focuses on AI for healthcare, specializing in clinical documentation, patient summarization, and EHR integration. Its models are trained on medical transcripts and optimized for accuracy, compliance (HIPAA), and doctor-patient context. Technically proficient within its domain, Sana reduces physician burnout by automating note-taking. However, it is not a general-purpose model. Its value lies in vertical specialization rather than broad intelligence. Ethically, Sana adheres to strict privacy standards, but reliance on sensitive health data demands rigorous oversight.
Verdict: A high-impact specialized AI in medicine. Not comparable to general LLMs, but exemplary in its niche.
Other Notable Models
Inflection AI (Pi)
Quality: ★★★★☆
Pi was designed as a personal, empathetic AI companion. While discontinued as a standalone product (after Microsoft acquired much of the team), its human-centered design set a new standard for emotional intelligence in dialogue. Inflection’s focus on kindness, active listening, and user well-being contrasted sharply with the performance-obsessed race elsewhere. Though technically less powerful than GPT-4, Pi excelled in supportive interactions.
Legacy: A reminder that AI can be helpful and kind—before commercial pressures took over.
NVIDIA (Nemotron)
Quality: ★★★☆☆
NVIDIA does not offer consumer-facing chatbots but develops foundational models (Nemotron) for enterprises to generate and fine-tune synthetic data. These are critical for training AI in domains with scarce real-world data. As the dominant GPU supplier, NVIDIA wields outsized influence over the entire AI stack. Its push into full-stack AI (software, networking, models) positions it as an infrastructure kingmaker.
Verdict: Not a direct competitor, but the most powerful enabler—and potential bottleneck—of the AI ecosystem.
Apple (Ajax / Apple GPT – rumored)
Quality: Unknown (Likely ★★★★☆ when launched)
Apple is developing large language models internally (codenamed Ajax), prioritizing on-device processing, privacy, and seamless integration with iOS. Expected to launch in 2024–2025, Apple’s AI could redefine user experience with deeply private, context-aware assistance. However, its late entry and reliance on on-device compute may limit model size and capability compared to cloud-based rivals. Downside is – apple. Apple has a persecutory stance towards people who prefer to operate outside its closed garden ecology products. If I want to use Ajax do I end up having to triple authenticate access with my phone and email every time? Ugh.
Potential: High. If Apple balances power with privacy, it could become the most trusted consumer AI.
The Downside: Apple’s “Persecutory” Ecosystem Culture
Apple’s long-standing security model—while effective at protecting users from external threats—often punishes the legitimate user in the process. Consider:
- Recovery Key Hell: Lose your device? Forget your password? Good luck recovering your data without a 14-day waiting period and a paper key you probably threw away.
- iCloud Lock & Activation Lock: Designed to prevent theft, but often traps users in bureaucratic purgatory.
- App Store Gatekeeping: Even with EU DMA reforms, Apple makes sideloading feel like a punishment, not a right.
- Continuity Clustering: Devices only work perfectly if you own 5 Apple products and never leave the ecosystem.
Now imagine applying that same philosophy to AI access.
- Require Face ID + passcode + Apple ID 2FA for every sensitive query?
- Refuse to sync your AI preferences across devices unless all are signed into the same account and within 3 feet of each other?
- Block third-party AI integrations unless they jump through 47 privacy and design hoops?
Baidu (Ernie Bot)
Quality: ★★☆☆☆
Ernie Bot is China’s earliest major LLM effort, but lags behind DeepSeek and Alibaba in performance and openness. Tied closely to Baidu Search, it suffers from inconsistent quality and heavy censorship. Useful primarily within China; lacks anything resembling global relevance.
Zhipu AI (GLM series)
Quality: ★★★☆☆
Another Chinese player with strong academic roots (Tsinghua University). GLM-4 shows solid performance, especially in Chinese language tasks. Offers API services and enterprise solutions. Like others, constrained by regulatory environment and limited international trust.

The European Union stands at a historic inflection point. For the first time since the dawn of the internet age, Europe has the opportunity to shape—rather than merely react to—the fundamental architecture of a transformative technology. The decisions made in Brussels over the next eighteen handful of months will determine not just regulatory compliance, but which AI companies become the infrastructure of human thought for the next generation.
This is not about managing American technological dominance. This is about the EU laying down rules, negotiationg hardbvall and prunig options. The EU must be willing to simply ban aggressive/predatory AI models from the EU markets.
The EU’s approach to AI governance will inevitably create winners and losers in the global marketplace. Companies that demonstrate genuine commitment to user dignity, data sovereignty, and democratic values will find themselves with privileged access to 450 million European minds. Those that continue operating under extractive, opaque models should be kicked to the proverbial curb.
The choice before European policymakers is clear: reward those who uplift, empower, and drive societal progress, while systematically disadvantaging those who prey on human vulnerability, exploit cognitive dependencies, or sow democratic division.

Much of the staff employed was previously hired from Facebook quality control people – people who routinely read and see the worst of the worst of humanity. Many of these IT professionals work at relatively low wages, exceptionally high living expenses, under competetive and precarious market conditions, working long hours. How subject to bribery are these individuals? Edward Snowden reported that NSA staff routinely investigated ex partners, routinely looked into naked phone pics of users outside the US, routinely interfered in credit records, routinely sabotaged and meddled in people’s life on a whim or for personal entertainment. We can clearly not trust the algorithms, but can we rust the overworked people behind those algorithms?
These models need not merely target specific individuals – we are surrounded by hospital records that constantly drift in and out of AI models. Many professional in high positions skirt the rules every now and then. If a Judge consults an AI model is that Judge now subject to blackmail? If an agency goes on a fishing expedition – everyone we known is now surrounded my hundreds of people that are likely to at some point discuss you, me, everyone reading this on whatever topics. If these topics are strung together into an AI generated database, the impact may be horrific.
AI models now have access to corporate data, brainstorming, sudden spurts if inspiration across millions of users. Take all these ephemeral insights and assemble these into coherent ideas, and in effect LLM’s can access the ingenuity and originality of literally hundreds of millions of users. An idea casually glossed over and ephemerally discussed may prove to be a billion dollar business model. In a few years some new managers at OpenAI, or who ever bought OpenAI to “harvest” ideas, generate revenue generating business models, and order AI to literally build these models. Now extend these dangers to Deepseek and Qwen and there is a near certainty that as we speak million of chinese enterpreneurs are scrambling to make money from mere ideas users in the EU once had.
This is not surveillance capitalism evolving—this is surveillance capitalism perfected. And it is happening with the enthusiastic cooperation of users who believe they are engaging in private conversations with helpful assistants.
